7 Issues to Know about the Wages Register in Spain.

The Wages Register is the document in which all the information about the wages paid by the company to its workers is collected. If you do not want to have serious problems with the Labor Inspectorate, there are 7 things you need to know and keep in mind:




(1) ALL companies have to draw up the Register even if they only have male-workers on their staff, and they do not have any female workers. Moreover, ALL companies have to keep the Wages Register, even in the case of self-employed with only one worker.


(2) The Wages Register has to break down and separate the salaries corresponding to men and women in the workforce, which casts doubt on the logic of this obligation in case that there is no female worker in the workforce, but I insist that even in these cases, the Register is mandatory.


(3) The purpose of the Wages Register is to guarantee the transparency of remuneration and to allow employees, through their representatives, to access salary information, including the information related to executive directors.


(4) The obligation to draw up the Wages Register was introduced by RDL 6/2019, and has therefore been in force since March 8, 2019. The Royal Decree No. 902/2020 has developed this obligation and entered into force on April 14, 2021.


(5)The Register has to include the arithmetic mean and median of the average values of: (1) salaries; (2) salary supplements and; (3) non-wage payments of the workforce.

(6) In addition, this Wage Register will be used when the company is also obliged to carry out an "Equality Plan".


(7) Finally, when the arithmetic mean or median of the total remuneration in the company of workers of one sex is at least 25% higher than that of the other sex, a justification of the reason for the difference must be included, and it must be justified that this difference is not due to the different sex of the affected workers.
